The former president’s statement came during a June 10 appearance on Miranda Devine’s “Pod Force One,” where he referenced recent flag burnings during protests in Los Angeles and blasted the lack of consequences:
“You burn the American flag, you go to jail for one year—no questions asked.”
What’s the catch?
Flag burning is protected free speech under the First Amendment. The Supreme Court has upheld this right multiple times, most notably in Texas v. Johnson (1989). Any law criminalizing it would likely be struck down—unless the Constitution is amended.
Trump’s comments come as he escalates his “law and order” rhetoric following military deployments to L.A. during immigration raids. Critics say he’s using moments of unrest to push unconstitutional crackdowns on dissent.
